Woman Wins Damages After Falling on 'Mushy' Grapes

Following a lengthy court battle, a shopper who was injured when she slipped on some grapes on the pavement has been awarded £111,859 in damages.

Samira Hassan, 57, was looking at the fruit stall outside a High Street grocer’s shop in 2005 when the accident happened.

Mrs Hassan suffered two broken wrists, as a result of which she had to incur care costs. The accident has also affected her employment prospects.

She brought a personal injury claim against the owner of the shop, Onkar Singh Gill. She argued that the grapes were ‘trodden in and mushy’ and that she had slipped despite wearing ‘sensible footwear’. A County Court judge awarded her a six-figure sum last year.

Mr Gill appealed against the decision. He argued that the shop front was swept five times a day and all reasonable precautions had been taken to ensure that customers did not suffer injury. However, the Court of Appeal upheld the decision of the lower court. In its view, the County Court judge had not erred in law, nor had he made any findings that were not supported by the evidence.
