Machine Operator Forced to Retire Early Awarded Compensation

A paving machine operator who was compelled to retire after an existing spinal condition was exacerbated by a workplace accident has secured more than £60,000 in compensation.

The man, who had 14 years' experience as a paver operator, was employed by a tarmac company in the West Midlands and was working on the construction of a new supermarket when the accident happened.

He was sitting on a paving machine, awaiting a delivery of tarmac, when a colleague reversed a lorry into him at speed. The paving machine was lifted off the ground, and the impact as it fell down again caused the man serious injuries to his lower back and left leg. The damage resulting from the crash accelerated the symptoms of a pre-existing prolapsed disc and the pain was so severe that he could no longer continue working as a machine operator. As his employer was unable to find him suitable alternative employment, he had no option but to retire seven years earlier than he had planned.

Since the accident, he continues to experience constant pain in his back and leg and relies on crutches on a daily basis. He also suffers from depression, for which he is undergoing treatment.

Initially, his employer was unsympathetic towards him. However, after the man brought a personal injury claim against the company, it admitted liability for the accident and the compensation settlement was agreed.
