Road traffic accident and loss of earnings

Michael, a self employed commercial carpet and window cleaner, was driving his work van when another driver crashed into the side of the van, trapping him inside it.  Michael suffered a broken collar bone and a permanent injury to his shoulder, which may require an operation in the future.  Michael was unable to work initially and had to employ staff to assist him, resulting in a loss of profit.  With treatment, Michael was able to get back to work but remained unable to carry out some of the heavier jobs.  The medical evidence indicated that due to the repetitive aspects of Michael’s job in cleaning, he would have had problems with his shoulder within 5 years which would have prevented him from carrying out the heavier jobs in any event.  Birkett Long was able to secure a settlement of £80,000 without the need to issue court proceedings.
