Topic
With a change in the law affecting tax treatment of payment in lieu of notice and a number of cases related to the timing of and communication of notice, we will consider some of the key issues around termination of employment.
With the change in the law first announced in the 2016 Budget finally coming into force, PILON’s can no longer be paid tax free. This is a significant change and the implications need to be properly understood by any HR professional involved with the drafting of contracts and negotiating settlement agreements.
The case of Newcastle upon Tyne Hospitals NHS Foundation Trust v Haywood has confirmed the long held view that notice to terminate employment will only be effective when the employee reads the notice, unless the employer has expressly provided to the contrary. Employers need to carefully consider the wording of their contracts in light of this ruling.
As well as the matters above we will also consider some common pitfalls for employers in dealing with and negotiating settlement agreements.
