In what was described as 'an extraordinary testament to the strength of the human spirit', a 10-year-old girl who suffered brain damage due to medical errors following her birth has secured a multi-million-pound compensation settlement.
Initially, the youngster was progressing well following her delivery at an NHS hospital. However, she suffered from hypoglycaemia during her first three days of life and the condition was not diagnosed as it should have been by medical staff. As a result, she has been left suffering from persistent, recurrent epilepsy, impaired vision and learning difficulties.
Through her mother, she sued the Kings College Hospital NHS Foundation Trust, which admitted liability for her injuries at an early stage. Following negotiations, the Trust agreed to settle her claim for a lump sum of £1.2 million, plus annual, index-linked and tax-free payments to cover the costs of her care for life.
The girl's parents also have another daughter who has serious disabilities and the Court paid tribute to them for their fortitude in coping with such difficult circumstances. Thanks to their efforts, the girl has made far better progress than would otherwise have been expected.
