At the end of last year the Local Democracy, Economic Development and Construction Act 2009 was passed. This brought in changes to the way in which construction contracts will operate in the future. Many of the potential changes discussed in our previous articles will be brought about.
However the Act is not yet law. Before it can come into force, a new Scheme for Construction Contracts has to be agreed. The draft was published in March of this year and responses were required by 18 June 2010. When it is finalised, the Act can then be brought into force. It is hoped that that will be some time later on this year.
We will bring you further details of the full changes shortly before the Act is brought into force.
