No Exemption for Wi-Fi Operators

The controversial Digital Economy Bill, which we reported on in our last issue of For Business, has now become law after it was rushed through Parliament ahead of the recent general election.

One of the most criticised provisions of the Act makes a subscriber to an internet access service liable for the copyright-infringing behaviour of other people using their service. Whilst the Bill was passing through Parliament concerns were raised that this could have a damaging effect on cafes, pubs, hotels, universities and libraries that offer wireless internet access and there were calls for an exemption for such organisations.

No such exemption has been granted under the Act and there are now fears that many organisations may stop offering free Wi-Fi access.

The Act may also cause problems for consumers who do not secure Wi-Fi connections in their own homes. It is therefore important that such individuals put appropriate measures in place to prevent access to unauthorised persons.
