Maintenance requirement for students

Education providers will no doubt have noticed that a number of their foreign national students for whom they have issued Certificates of Acceptance of Studies, and who then go on to apply for entry clearance or further leave to remain, have been refused on the grounds of not meeting the maintenance (funds) requirements of the points based system.

Following a recent decision in the immigration courts, called Pankina, the UKBA has published revised policy guidance for those students who were refused solely because they did not meet the maintenance (funds) requirements.

Students whose applications were refused within a certain time period can ask the UKBA to review their applications.

Education providers may want to review their records on students who did not use their Certificates of Acceptance of Studies simply due to a refusal of not meeting the maintenance requirements and urge those students to seek advice on asking for a review.
