Cookie Consent Now Required

Website operators are reminded that the grace period for achieving compliance with the requirements of the Privacy and Electronic Communications (EC Directive) (Amendment) Regulations 2011 has now expired.

From 26 May 2012, the requirement is not just to provide clear information about any cookies used but also to obtain consent from users or subscribers to store a cookie on their device. Consent must involve some form of communication where the individual knowingly indicates their acceptance.

The Information Commissioner’s Office has updated its guidance on how to comply with the new law to clarify the position as regards ‘implied consent’ for the use of cookies. There is also a short video answering FAQs.
